Please read this agreement carefully before accessing or using the information and services available through the site. By accessing or using the site, you agree to be bound by the following terms and conditions.
Use of the site
The information contain on the site does not represent professional advice and you acknowledge and agree that information published by propertyroles is intended to provide general information in summary form on legal and other issues.
The use of Resumes and other personal information supplied by users of this site is governed by our privacy policy. Please click here to view our privacy policy .
As a condition of using any services supplied by propertyroles, Advertisers must comply with all anti-discrimination and equal opportunity legislation.
Advertisers agree not to post any information in any Job or Project listing that is misleading, dishonest or known to be incorrect.
Advertisements which appear to discriminate on grounds of sex, race or disability are illegal and may result in proceedings being taken against both the advertiser and the publisher. If we believe that an advertisement may be discriminatory we may, at our discretion, either amend the advertisement or remove it from the site without consulting you. The Advertiser will not be eligible for any refund of amounts paid or due to be paid in respect of the posting or otherwise and we will inform you accordingly.
The information and services available on the site are provided for the sole purpose of individuals looking for employment opportunities and career information and for employers seeking to recruit staff. You may use, print and download information from the site for these purposes only and for no other personal or commercial purpose. You may not otherwise copy, display, transmit or distribute any material from the site.
You may not modify, copy, reproduce, republish, upload, post, transmit or distribute in any way any material from this site including code and software. You must not use the site for any purpose that is unlawful or prohibited by these terms of use.
You may not use data mining, robots, screen scraping, or similar data gathering and extraction tools on the site for establishing, maintaining, advancing or reproducing information contained on the site on your own website or in any other publication, except with the written consent of propertyroles.
All copyright, database rights and other intellectual property rights in the site and the material available on the site belong to propertyroles or its third party suppliers. Use of the site does not give you any proprietary rights in such materials.
propertyroles does not make any representation whatsoever about any Resume, advertisement or job vacancy advertised on the site, nor about any of the Advertisers or users who appear on the site. Users and Advertisers must satisfy themselves as to the suitability of any agency, employer, job, or Resume found directly or indirectly through this website.
Under no circumstances will propertyroles be liable to you or anyone else for any decision made or action taken by you or anyone else in reliance upon any information contained on or omitted from the site.
propertyroles provides no warranty to Advertisers that services available through the site will be uninterrupted or error free, propertyroles agrees to use its reasonable endeavours to ensure that any disruptions to or a denial of access to the site will be remedied as quickly as possible.
propertyroles cannot and does not guarantee or warrant to the User or Advertiser that files available on or emailed through the site will be free of infection or viruses, worms, Trojan horses or other malicious or harmful code. propertyroles will not be liable to you for any direct, indirect, consequential, special or other damage resulting from the transmission from this website to your computer systems of viruses, worms, Trojan horses or other destructive items, however caused, such damage to include, without limitation, loss of profits, interruption to business, loss of the whole or any part of a programme or any data howsoever stored whether saved on a computer system or otherwise.
Privacy
While propertyroles takes all due care in ensuring the privacy and integrity of the information you provide, the possibility exists that this information could be unlawfully observed by a third party while in transit over the Internet or while stored on propertyroles.com systems or on the site. propertyroles disclaims all liability to you to the greatest extent possible pursuant to law should this occur.
Advertisers
Advertisers agree at all times to deal with any information or products provided or accessed from the site in a manner which abides by all applicable laws, or of any other relevant jurisdiction (including, without limitation, privacy and copyright laws).
Advertisers must ensure that all advertisements posted on propertyroles comply with all applicable legislation, regulations, by-laws, ordinances or codes of conduct in all applicable jurisdictions.
Advertisers posting Jobs must post information that is accurate, truthful, and honest. Job postings must be posted only for Jobs that are current and legitimate at the time of posting. Job postings on the web site must be removed as soon as the positions are filled or for any reason no longer current.
propertyroles reserves the right to either reject or remove any job posting or Resume from its site for any reason whatsoever, including any advertisement or listing that is in breach of any law.
Advertisers may not assign or transfer any rights and obligations pursuant to this agreement to any other person or entity without propertyroles prior written approval. Approval will not be unreasonably withheld.
Advertisers posting Jobs must ensure that advertisements are posted to the appropriate categories and location, and that all other information is correct and accurate.
propertyroles reserves the right to edit, re-categorise, change or update a Job Posting, or Advertiser Profile at any time. This is generally only done to correct mistakes or omissions made by the User or Advertiser or where information is deemed otherwise inappropriate.
Advertisers agree that propertyroles may, at its discretion and without liability to you, remove from the web site any advertisement which is posted in breach of the following rules:
- No duplicating of jobs at the expense of other customer jobs.
- No gratuitous use of keywords in job descriptions or job titles. Gratuitous means deliberately inserting words, strings of words, or repeating job titles, with the intention of influencing position in the results listing, or increasing the number of page views.
- Job advertisements placed on the web site must be for genuine vacancies only, and not for other products or services, either relating to or unrelated to recruitment including, but not limited to, affiliate schemes, pyramid selling schemes or any other so called 'business opportunity'.
- URLs or email links (live or text only) are not permitted in the copy of the job description page.
These rules may change from time to time and you are advised to refer to them regularly.
propertyroles will use its reasonable endeavours to post all advertisements and listings submitted by Advertisers in the format submitted to the site and in accordance with the instructions of the Advertiser. propertyroles makes every effort to avoid errors in advertisements and listings it has agreed to post to the site however, accepts no responsibility or liability for any errors and requires that Advertisers check their listings for errors as soon as they are placed on the site.
Advertisers agree not to use any feature of propertyroles to send unsolicited emails, to any person or business for any reason. Legitimate communication tools provided within the site for the purpose of communicating with job seekers are the exception to this rule.
Advertisers accept that we cannot and do not screen, vet, or quality assess job seeker information (“Resumes”) placed on the site. We do the best we can to ensure a high level of quality and accuracy but we are not responsible for the validity or accuracy of information contained in these postings. propertyroles will not be liable for any loss, costs, damages or loss of profits sustained as a consequence of any User or Advertiser employing or engaging any person sourced through propertyroles.com or any job, contract, project, or freelance work sourced through the site.
Advertisers agree to deal fairly and professionally with individuals who may respond to an advertisement you have posted and not do anything which may bring the site into disrepute. You will indemnify us from and against any claim brought by an individual against the site arising from your breach of this obligation or any other of these terms and conditions.
We do not guarantee any response to your advertisement or that responses will be from individuals suitable for the job advertised. It is your responsibility to carry out such checks and procedures as are necessary to ensure that job seekers are suitable for the job advertised and have the required qualifications and personal characteristics.
You agree to deal fairly and professionally with individuals you may contact using information from the site and not do anything which may bring propertyroles into disrepute. You will indemnify propertyroles from and against any claim brought by an individual against the site arising from your breach of this obligation or any other of these Terms and Conditions.
Advertisers agree to indemnify propertyroles, its officers, employees and agents against all claims, actions, suits, liabilities, costs and expenses incurred on any account by propertyroles as a result of the listing or proposed listing by an advertiser on the site or any related site.
Advertisers agree to keep propertyroles, its officers, employees and agents fully indemnified against any actual or contingent costs, expenses, charges, damages or liabilities incurred in relation to any actions or claims brought by any person or entity against propertyroles as a result of an actual or alleged breach by you of any law, regulation, by-law, ordinance or code of conduct or such other actions or claims brought as a consequence of your posting appearing on the site.
Use of the Job seeker database
Access to the names and contact details of job seekers in the Resume database is available only to approved Advertisers who have registered and paid for access to the Resume database.
Advertisers may access and use the information stored on the Resume database solely for the purpose of identifying candidates for current or forthcoming job vacancies. Advertisers must not use a job seeker’s Resume or contact details for any purpose other than to help that person find a job. Breach of this clause may result in the Advertiser’s propertyroles membership being cancelled.
Job seekers
Job seekers posting Resumes must ensure that their Resume is posted to the correct categories, the correct locations, and that all other information is accurate truthful and honest.
propertyroles reserves the right to edit, re-categorise, change or update a Resume, at any time. This is generally only done to correct mistakes or omissions made by the User.
Job seekers agree at all times to deal with any information or products provided or accessed from the site in a manner which abides by all applicable laws, or of any other relevant jurisdiction (including, without limitation, privacy and copyright laws).
propertyroles reserves the right to either reject or remove any Resume from its site for any reason whatsoever.
propertyroles will use its reasonable endeavours to post all Resumes submitted by Users in the format submitted to propertyroles and in accordance with the instructions of the User. propertyroles makes every effort to avoid errors in Resumes it has agreed to post to the site however, propertyroles accepts no responsibility or liability for any errors and requires that Users check their listings for errors as soon as they are placed on the site.
Users accept that we cannot and do not screen, vet, or quality assess all job postings on the site. We do the best we can to ensure a high level of quality and accuracy but we are not responsible for the validity or accuracy of information contained in these postings.
Database rights and all other applicable copyright and intellectual property rights in the job seeker database belong to propertyroles. You acknowledge that you do not acquire any rights in the database or its content and that your retention and use of the database and its content is governed by these Terms and Conditions.
propertyroles gives no guarantee to you of the continued availability of any particular job advertised on the site and will not be liable to you should an advertiser have filled the vacancy at any time prior to removal of the advertisement from the site.
Whilst propertyroles makes efforts to ensure that jobs advertised are for actual job vacancies, it gives no guarantee to you that every job advertisement represents an actual job vacancy.
propertyroles does not endorse or recommend any of the jobs advertised on the site and strongly recommends that prior to entering into any agreement with any of the Advertisers on the site, you obtain your own independent legal, accounting, financial or taxation advice as appropriate.
Prices
Prices are guaranteed for the period stated on the website. A single job is identified by its unique ID number. If an advertiser deletes a job and then either reposts it or replaces it with another job posting this will be classified as a new job posting. If an Advertiser changes the Job Title, Sector, Function, Asset Class, Location or any significant descriptive wording of a posted job this will also be classified as a new job posting.
If any services to be used within any time period specified are not used within that period of time they may not be carried over into any subsequent time period unless the Advertiser purchases a new job pack of equal or greater value than the previously purchased job pack. The Advertiser will be responsible for payment for any unused services that are not permitted to carry over into another time period.
Payments and Refunds
Goods and Services Tax (GST) will be added to all advertised prices at the prevailing rate.
Prices will be charged in Australian Dollar (AUD) currency.
At propertyroles' discretion, Job Packs are to only be purchased by online Credit Card payments. propertyroles accepts Visa, Mastercard and Amex cards.
Please allow ten minutes after your purchase has been approved for Job Packs to appear in your propertyroles account.
In some circumstances propertyroles may choose to invoice advertisers. If invoices are provided then they are payable within 7 days of the invoice date. Late payment will entitle us to suspend provision of our services to you. Interest will be payable on late payments and will be equal to the sum of the Reserve Bank of Australia’s cash rate on the invoice date plus an additional 3% p.a.
Advertisers agree that propertyroles may, for the purposes of assessing an Advertiser’s commercial credit application, obtain from either a credit reporting agency or other credit providers, personal credit information about the Advertiser and/or its directors or a consumer credit report about the Advertiser from a credit reporting agency for the purposes of collecting overdue payments relating to commercial credit owed by the Advertiser.
Refunds on all payments will be made at the discretion of propertyroles.
Equipment
It is your responsibility to ensure that you have the appropriate equipment and are connected to the appropriate services to enable you to post jobs to the web site.
Third party sites
Vacancies you post on the web site may also appear on third party recruitment web sites pursuant to agreements from time to time between propertyroles and the proprietors of such web sites.
These sites are not under the control of propertyroles and propertyroles is not responsible for the contents of any linked site or any link contained in a linked site. The inclusion of any link does not imply endorsement by propertyroles of the linked site.
Browser and operating system policy
The web site endeavours to support as many users as possible, the website also requires job seekers to enable session cookies (enabling permanent cookies is recommended), and JavaScript, in their browser.
Passwords
Passwords are for the sole use of the person to whom they are issued. You are entirely responsible if you do not maintain the confidentiality of your password and login name and you are entirely responsible for any and all activities that occur under your login name.
We may deny access to a password if we reasonably believe that it is being used by an unauthorised person or that the user is breaching these Terms and Conditions.
You agree to immediately notify propertyroles of any unauthorised use of your login name or any other breach of security known to you.
Termination
Advertisers may terminate their account with no less than 30 days prior to expiration of any contract term. If the advertiser terminates their account before the end of the contract term they will be liable for the payment of all sums due up until the end of the contract.
We may terminate an Advertiser’s account if:
- the Advertiser is in material breach of these Terms and Conditions and has not remedied such breach within ten (10) days of notice specifying the breach and requiring that it be remedied, or:
- the Advertiser becomes insolvent, ceases to trade or goes into liquidation.
In all cases the Advertiser will be liable for the payment of all sums due up until the end of the contract
Termination of this agreement will not end those provisions that are capable of surviving the ending of this agreement.
Jurisdiction
Any agreement between propertyroles and an Advertiser is governed by the laws of New South Wales, Australia. Advertisers irrevocably and unconditionally submit to the non-exclusive jurisdiction of the Courts of New South Wales, and waive any objection to legal action being brought in those Courts on the grounds of inconvenient forum or venue.
Change of General Terms & Conditions
propertyroles reserves the right to materially alter these Terms and Conditions without notice.
